Actor Suraj Pancholi, the boyfriend of late British-Indian Bollywood starlet Jiah Khan, has been released on bail by a Mumbai court.
Judges said that Mr Pancholi, son of actors Aditya Pancholi and Zarina Wahab, could not be held solely responsible for the "impulsive" act by the 25-year-old actress, who was found hanged in her apartment last month.
Mr Pancholi was the last person that Ms Khan had spoken to before taking her own life.
Her parents later released an apparent suicide note which revealed that the young couple had been experiencing difficulties in their relationship.
Mr Pancholi, 22, was arrested after Jiah's mother, Rabiya Khan, accused him of abusing her daughter.
Legal experts had questioned the police move saying strong evidence was needed to prosecute anyone for abetting suicide.
A 2010 Supreme Court ruling said that to convict a person for abetting suicide, it has to be proved that they instigated it or that "there was a clear intention to commit the offence".
The Press Trust of India quoted Justice Sadhna Jadhav at the Mumbai High Court as saying: "No doubt that it was an unfortunate incident that a young girl has committed suicide. She must have been impulsive and he cannot be held solely responsible for it."
"She was in the relationship on her own volition. It all depends on the psyche of the person. It cannot be ignored that Jiah [Khan] had suicidal tendencies. Earlier also she had attempted suicide and it was the applicant [Mr Pancholi] who took care of her," Justice Jadhav added.
Mr Pancholi has been ordered not to leave the country and report to a police station in Mumbai every other day.BLOG COMMENTS POWERED BY DISQUS
